We take your privacy very seriously - your details are safe with us.
We will not pass on any of your details to anyone else (unless required to by law).
We will not fill your inbox with unsolicited emails – although we will of course be in touch during site design and provision of our services!
Terms Governing The Use Of Our Services
The Terms & Conditions can be accessed through our website at the location http://www.leaf-designs.com/terms.php
In these conditions "the client" means the person or company who has agreed to take out the services of Leaf Designs. The deliverables means the services and work specified in the quotation to be delivered by Leaf Designs to the client.
Fees
For each project, the client will receive a quotation outlining the project brief. We will begin work upon the client’s written or oral approval of the quotation. Quotations are valid for 30 days.
Payment
Unless otherwise agreed in writing by Leaf Designs, all clients will be required to pay 50% of the project cost before work can begin as a deposit and the remainder of the balance is due upon project approval. A 3.5% monthly service charge is payable on all overdue balances. The client shall be responsible for all collection or legal fees necessitated by late or default in payment. All deliverables shall be deemed complete once the client has signed off the work or indicated satisfaction either verbally, in writing, via e-mail or post. If the client fails to communicate with Leaf Designs for a period of more than 30 days without explanation, the project shall be deemed satisfactory and complete. Unless otherwise provided in the quotation the client shall pay additional charges for changes requested by the client which are outside the scope of the quotation on a time and materials basis, at Leaf Designs standard hourly rate of £25 per hour. Such charges shall be in addition to all other amounts payable under the quotation.
The deposit paid to Leaf Designs covers the cost of design work carried out as well as any admin work and communication with Leaf Designs. The deposit is non refundable.
Maintenance Policy
Maintenance is included for 30 days after work on the site begins. The client will be notified of this upon work commencing. During this month all updates to the site are free of charge, including, but not limited to, alterations to: text, graphics, layout, code and email accounts.
Maintenance is arranged on a ‘per hour’ basis: any work undertaken which falls outside the initial 30 day maintenance package will be charged at our standard rate of £25/hour. Minimum payment for any single maintenance work is £25 EXCLUDING text updates which, if less than 10 minutes of work, are provided free of charge. Clients will be notified if they qualify for this free service after the work has been carried out.
Clients are free to change their site or any of our provided services in any way after the service has been completed. Help and guidance for updating sites independently will be provided upon request and within reason.
Errors and omissions
It is the client’s responsibility to check all proofs carefully for accuracy. Leaf Designs is not liable for errors, such as typographic errors or misspellings and the client shall incur the cost of correcting such errors.
Accreditation
Leaf Designs retains the right to reproduce, publish and display the deliverables in Leaf Designs portfolios and websites, and in galleries, design periodicals and other media or exhibits for any purpose, and to be credited with authorship of the deliverables in connection with such uses.
Domain names and Web Hosting
The registration and use of your domain name is subject to the terms and conditions of use applied by the relevant naming authority; ICANN in the case of .COM/NET/ORG and Nominet in the case of domain names ending with .UK. You shall ensure that you are aware of those terms and conditions and that you comply with them. You shall have no right to bring any claim against us in respect of refusal to register a domain name. Any administration charge paid by you to us shall be non-refundable notwithstanding refusal by the naming authority to register your desired name.
We shall have no liability in respect of the use by you of any domain name; any dispute between you and any other person must be resolved between the parties concerned in such dispute. If any such dispute arises, we shall be entitled, at our discretion and without giving any reason, to withhold, suspend or cancel the domain name. We shall also be entitled to make representations to the relevant naming authority but will not be obliged to take part in any such dispute.
You shall indemnify us and keep us indemnified and hold us harmless from and against any breach by you of these terms of business and any claim brought against us by a third party resulting from the provision of Services by us to you and your use of the Services.
Refund Policy
If you are unhappy with any aspect of our service, please contact us and we will attempt to rectify the situation.
Refunds are not available for .COM, .NET, .ORG or any other domain names, SSL Certificates, Domain Transfer In fees, Domain Transfer Out fees, or any other products or services provided by Leaf Designs through other companies.
No refunds will be made if we terminate your services due to any other violation of our Terms and Conditions. This does not affect your statutory rights.
Governing Law - These Terms and Policies are governed in all respects under English laws.
